Last updated: 27 January 2026
These Terms and Conditions ("Terms") govern your access to and use of TrailTrack.co.uk (the "Website" or "Service"), including any member accounts, features, and subscription levels we provide. The Website is operated by the TrailTrack team ("we", "us", or "our").
By accessing, registering for, or using the Service in any way (including subscribing), you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. Who we are
TrailTrack.co.uk is operated by the TrailTrack team. For contact: theteam@trailtrack.co.uk.
2. Eligibility
You must be at least 13 years old to use the Service (or such higher age as required in your jurisdiction). By using the Service, you confirm you meet this requirement and have the legal capacity to agree to these Terms.
If you are under 18, we recommend discussing subscriptions with a parent or guardian before signing up.
3. Member Accounts
- To access certain features (such as uploading and viewing GPX routes), you must create a member account by providing accurate information (name and email).
- You are responsible for keeping your account secure, including your password. Do not share your account details.
- You must notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts for breach of these Terms, security risks, or other valid reasons.
4. User-Uploaded Content (GPX Routes and Other Files)
- You may upload GPX route files to your private member account.
- You retain ownership of any GPX routes or other content you upload ("Your Content"). By uploading, you grant us a limited, non-exclusive, royalty-free licence to store, display, and make Your Content available to you within your account only.
- All GPX routes are private to your account. We will never access, use, analyse, share, copy, or process Your Content for any purpose other than providing the Service to you, unless you give us explicit, separate consent.
- You confirm that Your Content does not infringe any third-party rights (e.g., copyright, privacy) and is not unlawful, harmful, offensive, or misleading.
- We may remove or disable access to any content that breaches these Terms, without notice.
- We are not responsible for the accuracy, safety, or suitability of any GPX routes you upload or use.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or abusive purpose.
- Upload viruses, malware, or harmful code.
- Attempt to gain unauthorised access to the Service, other accounts, or systems.
- Scrape, copy, or extract data from the Website without permission.
- Harass, impersonate, or mislead others.
- Interfere with the Service's operation.
We may suspend or terminate access for any breach.
6. Intellectual Property
- The Website, its design, text, graphics, and code (excluding Your Content) are owned by us or our licensors and protected by copyright and other laws.
- You may view and use the Service for personal, non-commercial purposes only. No reproduction, distribution, or commercial use without our written permission.
7. Subscriptions and Paid Features
- We offer three subscription levels: Free, Standard, and Premium. Details of features, pricing, and differences are shown on the Website or in your account dashboard.
- Subscriptions are annual, paid in advance, and will auto-renew each year on the anniversary of your purchase unless cancelled.
- Pricing is displayed inclusive of any applicable VAT. You authorise us (or our payment processor) to charge your chosen payment method annually in advance.
- You can cancel your subscription at any time via your account dashboard — cancellation prevents auto-renewal and takes effect at the end of the current annual period (no refunds for partial years unless required by law, such as the 14-day cooling-off period for digital services).
- We may change pricing, features, or subscription levels with reasonable notice (e.g., via email or site announcement). Continued use after changes constitutes acceptance.
8. Liability and Disclaimers
- The Service is provided "as is" and "as available". We do not guarantee uninterrupted access, error-free operation, or that GPX routes will be accurate/safe for any activity.
- To the maximum extent permitted by law, we exclude all warranties and liability for loss or damage arising from use of the Service, including indirect/consequential loss, data loss, or injury from following GPX routes.
- Nothing in these Terms excludes or limits our liability for death/personal injury caused by negligence, fraud, or any matter that cannot be excluded under UK law (including the Consumer Rights Act 2015).
- You use GPX routes and any location-based features at your own risk. Always follow safety guidelines and do not rely solely on digital data for navigation.
9. Termination
We may suspend or terminate your access at any time for breach of these Terms or for any other reason, with or without notice. You may close your account or cancel subscriptions at any time via your dashboard.
10. Changes to the Service or Terms
We may update these Terms from time to time. Changes will be posted here with a new "last updated" date. Continued use after changes constitutes acceptance. We may also modify, suspend, or discontinue features of the Service.
11. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
